Terms of Use

The following terminology applies to these Terms and Conditions, Privacy Statement and any or all Agreements: “Website”, “site” and “the site” refers to PropertyMarketingAustralia.com.au. “Client”, “You” and “Your” refers to You, the person accessing this website and accepting the Company’s terms and conditions. “The Company”, “Ourselves”, “We” and “Us”, refers to our Company. “Party”, “Parties”, or “Us”, refers to both the Client and ourselves, or either the Client or ourselves. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same.

Images belonging to Property Marketing Australia PMA©  taken from the website www.propertymarketingaustralia.com.au and or image re-used from another agent, or listing for new agent/s for a re-listing other than for the purposes taken for the initial booking agent/s will be breaching Australian copy-write laws. Any images used without our written consent will incur a usage fee of $120 per image, floor plan, site plan and video or a flat fee of $800 for up to 8 images including a floor plan, persons, businesses re-using our images will also incur the debt recovery fee’s associated with collecting payment.

All accounts are strictly 14 days from the date of invoice, Account fees of $50 (fifty dollars) will be charged to the account on (of each invoice if over 7 days (Seven days) for administration & collection fees. Canceled bookings (on the day of booking/s) will incur a cancellation fee of $85 (eighty-Five dollars). All images are the property of PMA until paid for in full of any particular address or booking and the images floor plans, video/s creative works are for and only for the address and can not be re-used for any other purpose without written approval from the owners, PMA. Weekend work & after-hours work will incur additional fees please confirm after-hours booking fees prior to confirming bookings.

Client records are regarded as confidential and therefore will not be divulged to any third party, unless you have opted in to our autoresponder system and if legally required to do so to the appropriate authorities. Clients are requested to retain copies of any literature issued in relation to the provision of our services or services of this site. We will not sell, share, or rent your personal information to any third party or use your e-mail address for unsolicited mail. Any emails sent by this Company will only be in connection with the provision of agreed services and products.

By accessing this website, and using our services or buying our products, you consent to these terms and conditions and to the exclusive jurisdiction of the English courts in all disputes arising out of such access. If any of these terms are deemed invalid or unenforceable for any reason (including, but not limited to the exclusions and limitations set out above), then the invalid or unenforceable provision will be severed from these terms and the remaining terms will continue to apply. Failure of the Company to enforce any of the provisions set out in these Terms and Conditions and any Agreement, or failure to exercise any option to terminate, shall not be construed as waiver of such provisions and shall not affect the validity of these Terms & Conditions or of any Agreement or any part thereof, or the right thereafter to enforce each and every provision. These Terms and Conditions shall not be amended, modified, varied or supplemented except in writing and signed by duly authorized representatives of the Company.

Waiver: Failure of either Party to insist upon strict performance of any provision of this or any Agreement or the failure of either Party to exercise any right or remedy to which it, he or they are entitled hereunder shall not constitute a waiver thereof and shall not cause a diminution of the obligations under this or any Agreement. No waiver of any of the provisions of this or any Agreement shall be effective unless it is expressly stated to be such and signed by both Parties.

Notification of Changes: Due to the Internet’s rapidly evolving nature the Company reserves the right to change these conditions as it sees fit and your continued use of the site will signify your acceptance of any adjustment to these terms. If there are any changes to our privacy policy, we will announce that these changes have been made on our home page and on other key pages on our site. These terms and conditions form part of the Agreement between the Client and ourselves. Your accessing of this website or search of information from this website indicates your understanding, agreement to and acceptance, of the Disclaimer Notice, Privacy Notice and the full Terms and Conditions contained herein. Your statutory Consumer Rights are unaffected.

Account Terms Of Trade

All account terms are strictly 7 per the invoice and or your account conditions provided.

All canceled bookings on the day will incur a $75 fee. Bookings can be canceled 24 hours prior to the booking time made. Our systems are in place to assist all customers with confirmation emails three days (2-3) prior to booking and the automated system txt two (2) hours prior to booking.

All Development / Creative / Marketing / Design works / CGI / Development/s are to be paid in milestones agreed with the first payment made prior to project commencement.

Late fees will apply of $50 per seven (7) days past due of invoice date and will accumulate every week till invoice/s is/are paid in full and is the discretion of Property Marketing Australia Pty. Ltd. PMA to wave and or pursue this fee in full.

All bookings made by agents, agents staff and or persons of employment on behalf of an agent and or PMA customer is acting on behalf of the owner, directors, principal of the business and the owner, directors, principal of the business personally guarantees all payments to Property Marketing Australia Pty. Ltd. as part of the account Terms Of Trade.

Any debt recovery costs associated with any accounts outstanding for more than 14 days (including any late fees) will be paid by the account holder owner, directors, principal of the business if you open an account with Phillip Kozis T/A Property Marketing Australia PMA©.
