Services Agreement | Credit Application | Payment Guarantee
Services, Images, video, virtual tours, multimedia, digital products, Design, HTML Templates, CSS, drawings, floor plans, for real estate marketing purposes: Called “Services”. In using the Services supplied to you on disc or electronically, you are agreeing to the following terms and conditions: Property Photography, Property Floor Plans, Property Aerials and Property Video and social media content. As Of August 01st-2021 as the new management and Full and only owner or Phillip Kozis T/A Property Marketing Australia PMA©.
Property Photography, Property Floor Plans, Property Aerials, and Property Video and social media content.

Usage of “Services”
Unless otherwise stated in writing by Phillip Kozis T/A Property Marketing Australia PMA©, to be mentioned as Property Marketing Australia PMA© any Services supplied by Property Marketing Australia PMA© now or in the future is to be used for your originally stated purposes only. Copyright is held by property Marketing Australia PMA©, and is not transferable unless requested in writing at which all Services will still remain the intellectual property of Property Marketing Australia PMA© and can be used to promote Services online and or print for self-promotion.
All Services are to be used for the original marketing campaign by the original real estate agency client only. The current owner of the property (at the time the order is placed with Property Marketing Australia PMA©) may also use the Services as a personal memento but does not retain any copyright for commercial purposes, rights for conditional, non-exclusive usage are licensed only upon full payment of the invoice. If any images are used prior to full payment-you are in breach of copyright. Any request for publication and/or sub-licensing of our Services (via print or internet or any other medium) taken by Property Marketing Australia PMA©, which is outside the specified original marketing campaign (including any use by architects, builders, painters, kitchen suppliers, stylists and any print or web publications), must be made in writing to Property Marketing Australia PMA©, for our consideration to releasing to third parties, an administration & release fee will apply of $350.
No alteration or manipulation of the image, plan may be made without the permission of Property Marketing Australia PMA©.
Some of the Services may have been manipulated at the owner’s and/or agent’s request, so please check on the appropriate laws relating to the publication of these Services. The party which has ordered these Services agrees to assume all legal liabilities relating to the publication of these Services in full without any recourse to Property Marketing Australia PMA© and or it’s employees.
Account Holders
If full payment of the supplied invoice is not made within 7 days of receiving the invoice, the statement you will be charged and is the discretion of Property Marketing Australia PMA© to charge additional fees of $89.00 per every seven (7) days for account keeping and administration, collection fees, bank transfer rejected, cheque dishonored, etc. If the invoice has not been paid in full, filing and legal fees, collection agency fees, administration fees and the State percentage approved being of the time of lodgement and or 14% of the outstanding will be incurred by you. Any breaches in copyright will be pursued vigorously. You agree to pay all collection costs incurred by Property Marketing Australia in the event of a payment default.
No Property Marketing Australia staff shall be liable for any legal action, claim or damages resulting from or arising out of the publication of the Services or other use.
Non-Account & Account Holders Payment terms: Under $3000.00AUD or our discretion.
All orders under $3,000 the client shall make payment within the following terms:
Property Photography, Property Floor Plans, Property Aerials and Property Video and social media content.
- Unless otherwise negotiated, payment is to be made in full on receipt of the approved quote; COD payment by (3). in this section.
- All payments are to be made in full within 7 days date of invoice with an account in place.
- Payment shall be made by either:
- Direct electronic deposit
- Cash
- PayPal
Non-Account & Account Holders Payment terms: Over $3000.00AUD or our discretion

Real Estate Photography, Real Estate Floor Plans, real Estate Video Production, Real Estate Aerials, Real Estate social content Creation and management.
The client shall make payment within the following terms:
- 50% deposit on receipt of approved quote
- 50% progress installment at the commencement of production
- if a website, before multimedia, before printing is produced, posted live or;
- All payments are to be made in full within 7 days date of invoice with an account in place.
- If print work, prior to finished work being handed to the client and/or forwarded to the printer, hosting provider, supplier, third party.
- All payments are to be made in full within 7 days of the date of invoice for account holders. COD for non-account holders, (see above for non-account holders)
Terms: Non-account holders & projects over $5,000AUD with or without an account:
- 50% deposit required prior to commencement
- 50% balance payment required prior to release of high resolution photographs / video / multimedia / websites / landing pages / floor plans / graphic design / Content creation / Social development and creation and all other services provided to you for your business.
Services for purposes other than Real Estate marketing / Production imagery / Photography Retail & or commercial.
Please note, in using the Services supplied to you on disc or transferred electronically, you are agreeing to the following terms and conditions:
Services Cancellation Policy:
Before booking with Property Marketing Australia please ensure to understand completely the result of cancelling a photo shoot WITHIN 24 HOURS OF THE SHOOT DATE.
If a photo shoot is canceled WITHIN 24 HOURS OF THE SHOOT DATE and the client (YOU THE OWNER, AGENT) can not reschedule to another date, then an $80 booking fee is non-refundable and an account will be sent by Property Marketing Australia for full payment by the booking owner, agent, owner. For Bad weather, rain, emergency issues events, outside the control of the agent, owner, booking agent it will be the discretion of Property Marketing Australia PMA© before or on the day, and a rescheduled date and time will be booked by Property Marketing Australia PMA© and the booking agent, booking owner.

Usage of Services:
Usage is as per the original written agreement or terms & conditions agreed to by you. If there is no written agreement, usage is for one media only and limited to 1 year use beginning from services date and must be paid in full prior to usage. Copyright is held by Phillip Kozis T/A Property Marketing Australia PMA©. You agree to all these terms and conditions and any alterations to these terms and conditions without necessarily being notified of these alterations.

You agree to pay all collection costs incurred by You, You agree to all these terms and conditions and any alterations, additions ordered on the day of services, by phone, email, verbal being performed by us and agree to these terms to pay in full without necessarily being notified of these alterations being made onsite, by phone, email, verbal with our staff. Orders and Accounts
When signing the account application you agree that on our acceptance of you application through our online Account request form and checking the “I Agree” & “Please Start My Account” that you or employees of your company may place an order using paper, verbally or electronically including via SMS, email or telephone. This order is considered to be an official order from your company and is subject to all the terms and conditions listed here.
Cancellation / Re-booking / Holt of works by the Agent and/or Client
The client agrees to provide timely responses to Property Marketing Australia PMA© after receiving status notifications, work for review or requests for information. The client shall have 24 hours to respond to each draft/request/update/new booking schedule due to rain or vendor cancellation for information submitted. If the client has failed to respond after 24 hours, Property Marketing Australia PMA© will deem the project complete and submit an invoice for full payment on works completed including fees relating to cancellation, works policies. At such time, Property Marketing Australia PMA© shall have no further obligation to the client, and the client shall pay Property Marketing Australia all fees and expenses associated with the work performed in full.

Legal Obligations and Expenses:
You personally guarantee and agree to pay for all invoices, statements for services ordered, performed by Property Marketing Australia PMA©. Any legal, collection and related expenses incurred or made by us, account keeping fee’s, collection fee’s, legal fee’s You agree to pay these fees to make good any out of pocket expenses including account keeping fee’s.
You agree to all these terms and conditions and any alterations to these terms and conditions without necessarily being notified of these alterations. Please check this site from time to time to stay informed of what you are agreeing to, if this is unclear, please contact us in writing with any questions prior to sending the application. If at any stage you do not agree to these terms and conditions and personal guarantee to pay in full, you must notify Property Marketing Australia in writing. You agree that all orders are made by yourself, your company staff or you and your company’s current or former employees of bookings being completed, delivered to you for your marketing.
